Terms and Conditions

1. Scope

These Terms and Conditions apply to all sales, deliveries and services provided by Polaris Sauna. By placing an order, the Customer accepts these Terms and Conditions as binding. Deviating terms of the Customer shall not apply unless expressly confirmed in writing by Polaris Sauna.

2. Product Characteristics

Saunas and sauna accessories are made of natural materials. Wood may show variations in colour, grain, knots, cracks or warping due to natural processes. These variations do not constitute defects and shall not give rise to warranty claims.

The typical operating temperature range for sauna use is generally between 80°C and 90°C at bench level. Actual temperatures may vary depending on the specific installation and operating conditions. Polaris Sauna Ltd. does not guarantee the achievement of any particular temperature.

3. Contract Conclusion

A purchase agreement is concluded once Polaris Sauna confirms the Customer’s order by e-mail. Polaris Sauna reserves the right to refuse orders at its sole discretion.

4. Prices and Payment

All prices are stated in Euro and include VAT unless otherwise specified. Payment is due immediately upon conclusion of the contract. Accepted payment methods are bank transfer, credit card, and PayPal.

4.1 Deposit Payment Option

For selected products, Polaris Sauna offers a split payment option consisting of a 40% deposit upon order confirmation and the remaining 60% payable prior to delivery.

Receipt of the deposit constitutes the Customer’s binding confirmation of the order and authorisation for Polaris Sauna Ltd. to commence production. Upon receipt of the deposit, materials are allocated, production capacity is reserved and customer-specific manufacturing begins.

As Polaris Sauna products are individually manufactured to the Customer’s specification, the order can generally no longer be cancelled after the deposit has been received. Any right of withdrawal or cancellation shall be governed exclusively by the applicable statutory provisions and the Returns & Refunds Policy.

5. Retention of Title

Ownership of the goods remains with Polaris Sauna until full payment has been received.

6. Delivery and Shipping

The terms of delivery and shipping are regulated separately in our Shipping Policy. These form an integral part of this contract.

7. Returns and Refunds

The terms for returns, refunds and the right of withdrawal are regulated separately in our Returns & Refunds Policy. These form an integral part of this contract.

8. Installation and Accessibility

Installation services are provided under the condition that the installation site is freely accessible and can be reached without the use of extraordinary equipment unless otherwise agreed.

Where delivery and installation require lifting the sauna into the garden with a crane, Polaris Sauna offers a crane service subject to additional costs. The Customer shall ensure that there is sufficient space for the crane to be positioned and that it is technically feasible to lift the sauna over the house or other obstacles. The costs for the crane service will be communicated in advance and invoiced separately. If crane delivery is required but cannot be carried out due to site conditions, Polaris Sauna reserves the right to refuse installation and to charge the Customer for any costs incurred.

The Customer is responsible for ensuring unobstructed access and sufficient space for delivery and assembly. The Customer must also ensure that the foundation or surface is level, stable and suitable for the installation.

8.1 Ground Conditions and Screw Pile Foundations

Where Polaris Sauna Ltd. supplies, arranges or recommends screw pile foundations, foundation preparation or other ground works, all such works are subject to suitable ground conditions.

The Customer acknowledges that underground conditions cannot be fully assessed prior to installation. Hidden obstacles, including but not limited to rock, boulders, buried concrete, foundations, tree roots, utilities, drainage systems or other underground obstructions may prevent or significantly affect the installation.

Polaris Sauna Ltd. will use reasonable skill and care to complete the installation. However, Polaris Sauna Ltd. does not guarantee that screw piles or other proposed foundation systems can be installed successfully.

If the planned foundation solution cannot be completed due to unforeseen ground conditions, Polaris Sauna Ltd. may recommend an alternative solution. Any additional labour, specialist equipment, materials or subcontractor costs required to complete the installation shall be quoted separately and must be approved by the Customer before such work is carried out.

Where work has commenced but cannot be completed because of unsuitable ground conditions, Polaris Sauna Ltd. reserves the right to charge for work already performed, including but not limited to site attendance, transport, labour, equipment hire, specialist contractor charges and any materials used.

Unless expressly agreed otherwise in writing, Polaris Sauna Ltd. does not warrant the suitability of the Customer’s ground or subsoil for any particular foundation system.

9. Planning Permission and Electrical Connection

9.1 Planning Permission and Electrical Connection

The Customer is solely responsible for ensuring that all safety clearances to combustible materials, ventilation requirements, floor protection and installation specifications as defined in the respective heater manufacturer’s installation manual are strictly observed. Polaris Sauna Ltd. does not verify, supervise or approve the installation location, safety distances or compliance with manufacturer safety requirements. Failure to comply with these requirements may result in serious damage or fire. Polaris Sauna Ltd. accepts no liability for any damage, loss or injury resulting from non-compliance with the manufacturer’s safety and installation instructions.

9.2 Customer Responsibility for Planning Permission and Electrical Installation

It is the sole responsibility of the customer to ensure compliance with all local planning, building and electrical regulations before installing a sauna or related product. Polaris Sauna Ltd does not provide legal, planning or electrical advice and cannot guarantee whether planning permission, building approval or any other consent is required in a specific case. Customers are advised to confirm all requirements with the relevant authorities before installation.

All electrical connections for saunas and related equipment must be carried out by a certified electrician engaged by the customer. Polaris Sauna Ltd does not perform electrical installation works, does not provide the electrical supply to the sauna and does not connect heaters, control units or other electrical equipment to the property’s electrical system. Polaris Sauna Ltd may install sauna equipment and route manufacturer-supplied sensor and control cables within the sauna structure as part of the assembly process. The customer’s electrician is solely responsible for providing the electrical supply, completing all required electrical wiring, making all final electrical connections, verifying compliance with applicable regulations and commissioning the installation in accordance with local regulations and the manufacturer’s instructions.

Polaris Sauna Ltd shall not be held liable for any delays, additional costs, damages, losses, defects, non-compliance issues or operational problems arising from the customer’s failure to obtain the necessary permissions, arrange a qualified electrician or ensure the proper installation, connection and commissioning of electrical components.

10. Warranty, Statutory Rights and Guarantees

10.1 Consumers (B2C)

For consumers, statutory rights under Irish and EU consumer law apply.
These statutory rights include the right to remedies for defective goods and cannot be excluded or limited.

The statutory warranty period for consumers is two (2) years from the date of delivery.

During this period, Polaris Sauna Ltd. shall, at its discretion, remedy defects that existed at the time of delivery by repair or replacement, provided that the product has been installed and used in accordance with the manufacturer’s instructions and for private, non-commercial purposes.

For defects occurring within the first twelve (12) months, it is presumed that the defect existed at the time of delivery, unless proven otherwise.

Statutory rights apply independently of any manufacturer’s warranty and are not replaced or limited by such warranty.

10.2 Manufacturer’s Warranty

Certain products may be covered by a manufacturer’s warranty in addition to statutory rights.

The scope, duration and conditions of any manufacturer’s warranty are determined exclusively by the respective manufacturer.

Polaris Sauna Ltd. does not act as the warranty provider and does not assume any independent guarantee obligations.
However, Polaris Sauna Ltd. supports customers with the administrative handling and communication of warranty claims with the manufacturer.

10.3 Business Customers (B2B)

For customers purchasing goods for commercial or professional use, statutory consumer protection rules do not apply.

Commercial or professional use includes, in particular, use in hotels, guesthouses, B&Bs, rental operations or similar commercial activities.

Unless expressly agreed otherwise in writing, the warranty period for business customers is limited to twelve (12) months from delivery.

The burden of proof that a defect existed at the time of delivery lies with the business customer.

Warranty claims are excluded in particular where defects result from:

  • commercial or intensive use,

  • improper installation,

  • non-compliance with manufacturer specifications,

  • modifications or repairs carried out by third parties,

  • normal wear and tear.

Manufacturer warranties, where applicable, apply solely in accordance with the manufacturer’s terms.
Polaris Sauna Ltd. does not provide any independent warranty to business customers.

10.4 Exclusions

Warranty claims for both consumers and business customers are excluded where defects are caused by:

  • improper or negligent use,

  • installation not carried out by qualified professionals where required,

  • failure to comply with operating, safety or maintenance instructions,

  • external influences beyond Polaris Sauna Ltd.’s control.

10.5 No Guarantee of Availability or Operation

Unless expressly agreed in writing, Polaris Sauna Ltd. does not guarantee uninterrupted operation, availability, or fitness for a specific commercial purpose.

In particular, Polaris Sauna Ltd. shall not be liable for loss of use, loss of revenue, or business interruption.

11. Liability

Polaris Sauna shall not be liable for damages resulting from improper use, self-installation by the Customer, or modifications carried out by third parties. Liability is limited to the value of the purchased goods, except in cases of intent, gross negligence or personal injury.

12. Force Majeure

Polaris Sauna shall not be liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, shortages of raw materials, transport disruptions, or government actions.

13. Communication

Notices and declarations shall be valid if made in writing or by e-mail to the addresses provided by the Customer during the order process.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms and Conditions.

15. Severability

If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions shall remain unaffected.

16. Amendments

Polaris Sauna reserves the right to amend these Terms and Conditions. Customers will be informed of changes in due time.

Final Provisions

These Terms and Conditions apply in the version valid at the time the order is placed. Any subsequent amendments shall apply only to future contracts unless otherwise required by law.
